The Quran repeatedly establishes the legal validity of necessity through clear rulings, particularly concerning dietary prohibitions in verses like Al-Baqarah 2:173, Al-Ma'idah 5:3, Al-An'am 6:119, Al-An'am 6:145, and An-Nahl 16:115. While carrion, flowing blood, swine, and idols' offerings are strictly prohibited due to their inherent spiritual or physical filth, the Quran explicitly suspends these prohibitions for anyone driven by extreme circumstance.

True nature of dire necessity

The core reality of necessity is a genuine, unavoidable fear of losing one's life or losing a vital bodily limb if forbidden sustenance is not consumed. As noted in Al-Ma'idah 5:3, this includes severe hunger (مخمصة makhmasah) where one's stomach literally contracts from starvation. As Al-An'am 6:119 states, necessity carves out an explicit exception to divine prohibitions, making the forbidden temporarily lawful.
Scholars explain that this condition manifests in two ways:
- A person has no lawful alternative available whatsoever.
- Lawful sustenance exists, but the person is compelled under severe threats to consume the forbidden.
This concession is temporary and strictly bounded. Once the immediate danger to survival passes, the original prohibition instantly returns. Crucially, refusing to consume the concession to the point of dying is a sin, because Allah explicitly commands believers not to cast themselves into destruction with their own hands Al-Baqarah 2:195.

Forms of dire necessity

The Quran and legal principles address several practical forms of necessity:
- Consuming forbidden food or drink: Swine, carrion, and other illicit items become lawful to survive. Jurists extend this to wine only in sudden emergencies when choking on food with no other liquid available, or to stave off freezing to death. Regarding medical treatment, scholars differ: while hadiths discourage treating illness with unlawful substances, some allow it under strict conditions where no halal alternative exists, without seeking pleasure, and under the precise direction of a trustworthy physician. Similarly, anesthetic drugs are permitted during surgery to block unbearable pain, and regulated painkillers are permitted when necessary without causing intoxication An-Nisa 4:29.
- Protecting life against destruction: The prohibition against taking life in An-Nisa 4:29 and courting ruin in Al-Baqarah 2:195 means that failing to take an available concession when starving is itself a form of wrongful self-destruction.
- Uttering words of disbelief under duress: When subjected to lethal torture, a believer may utter words of disbelief with the tongue, provided the heart remains anchored in complete faith An-Nahl 16:106, following the precedent of the companion Ammar ibn Yasir.

Conditions for establishing dire necessity

To ensure that necessity remains a righteous shield rather than an excuse for personal desire, scholars outline four essential conditions:
- Certainty or strong presumption of harm: You must have certainty or an evidence-based strong presumption that real destruction or bodily loss will happen. Mere weak doubts, illusions, or future hypothetical fears do not qualify An-Nahl 16:115. The law relies on strong presumption because demanding absolute certainty in every crisis would impose unbearable hardship, which contradicts Allah's intent of ease Al-Baqarah 2:185, Al-Baqarah 2:286.
- Complete unavailability of lawful means: You can only turn to the forbidden when all lawful ways to remove the harm have failed, in line with fearing Allah to your utmost ability At-Taghabun 64:16, which lightens strict demands Ali 'Imran 3:102.
- Choosing the lesser of two harms: When facing two bad outcomes, the lighter harm is chosen to avoid the greater evil. Consuming an illicit item is a lesser evil than losing human life An-Nisa 4:29.
- Necessity is measured strictly by its proportion: One may only take the exact minimum needed to preserve life, without desiring pleasure, eating to full satiety, or rebelling against limits Al-Baqarah 2:173, Al-Ma'idah 5:3.
